Terms of Service

1. Acceptance of Terms
By accessing or using AskJim ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. AskJim reserves the right to update these Terms at any time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.
These Terms apply to all users of the Service, including operators who submit data and those who access market intelligence reports and benchmarks.
2. Service Description
AskJim is a market intelligence platform designed for Canadian senior living and retirement home operators. The Service provides:
- Occupancy benchmarks and market positioning data
- Rate and care pricing intelligence
- Demand and demographic analysis
- Aggregated market trends and comparables
All benchmarks and intelligence are derived from anonymized, aggregated operator-submitted data. AskJim is independent, operator-neutral, and does not provide financial, legal, or pricing advice.
3. Data Collection & Use
AskJim collects data from three sources:
- Operator-submitted data: Information voluntarily provided by participating operators, including occupancy rates, suite-level pricing, care fees, and operational metrics. This is AskJim's primary and authoritative data source for all market benchmarks.
- Community profile data: When you provide your community's website URL during registration, you authorize AskJim to read publicly displayed information from that website solely to pre-populate your community profile (community name, address, contact details, care types, amenities, suite types). All auto-populated information is presented to you for review and confirmation before it is stored. You may edit, remove, or correct any pre-populated data during the confirmation process. AskJim does not store or use any website data that you do not explicitly confirm.
- Regulatory registry data: Where available, AskJim may reference public regulatory filings (e.g., RHRA registry listings, provincial retirement-home registries) to validate community identity. This data is not used as a source for market benchmarks or pricing intelligence.
All operator-submitted data undergoes the following processing before inclusion in any benchmark or report:
- Anonymization: All identifying information is removed. No operator name, property name, or specific address is disclosed.
- Aggregation: Data is combined across a minimum of five (5) operators before being presented in any benchmark. No individual operator's data is ever isolated or identifiable.
- Time delay: Operator-submitted data is subject to a minimum three (3) month delay before inclusion in benchmarks, ensuring that current competitive positioning is never disclosed.
4. Competition Law Compliance
AskJim is committed to full compliance with the Canadian Competition Act and all applicable competition and antitrust laws. The following provisions are a material part of these Terms.
4.1 Independent Third-Party Platform
AskJim operates as an independent third-party benchmarking platform. AskJim is not owned, controlled, or operated by any senior living operator, industry association, or group of competitors. All data collection, processing, and dissemination decisions are made solely by AskJim.
4.2 Anonymization & Aggregation Safeguards
All benchmarks and market intelligence provided through the Service are based on data that has been:
- Anonymized to remove all operator-identifying information
- Aggregated across a minimum of five (5) operators so that no individual operator's data can be reverse-engineered or identified
- Reviewed to ensure that no data point or combination of data points could reasonably be used to identify a specific operator's competitive information
4.3 No Disclosure of Individual Operator Data
AskJim does not disclose, share, or make available any individual operator's submitted data to any competitor, third party, or other user of the Service. Individual operator data is used solely for the purpose of generating anonymized, aggregated benchmarks.
4.4 Time-Delayed Data
All operator-submitted data is subject to a minimum three (3) month delay before inclusion in any benchmark or report. This time delay ensures that benchmarks reflect historical market conditions rather than current competitive positioning.
4.5 Market Intelligence Only
AskJim provides market intelligence and benchmarking data only. The Service does not provide, suggest, or imply:
- Pricing recommendations or suggested rate changes
- Guidance on whether to raise, lower, or maintain rates
- Coordination mechanisms between operators
- Any form of pricing strategy advice
All data presented is for informational and internal decision-making purposes only.
4.6 User Obligations
By using the Service, you agree that:
- You will not use AskJim data to coordinate pricing, occupancy strategies, or any other competitive decisions with any competitor
- You will not share AskJim benchmarks or reports with competitors for the purpose of price coordination or market allocation
- You will use AskJim benchmarks solely for internal decision-making within your own organization
- You acknowledge that AskJim benchmarks are retrospective market intelligence and are not signals, recommendations, or instructions regarding future pricing or competitive conduct
- You will comply with all applicable competition and antitrust laws in your use of the Service
4.7 Compliance Monitoring
AskJim reserves the right to suspend or terminate access to any user who, in AskJim's sole discretion, appears to be using the Service in a manner that may violate competition law or these Terms.
5. Prohibited Uses
You agree not to use the Service to:
- Fix or coordinate prices: Use AskJim data to agree, directly or indirectly, with any competitor on pricing, rate structures, rate increases, or rate timing
- Allocate markets: Use AskJim data to divide or allocate geographic markets, customer segments, or service categories among competitors
- Coordinate competitive conduct: Share AskJim data with competitors for the purpose of coordinating occupancy strategies, promotional offers, or any other competitive behaviour
- Share login credentials: Share your account credentials with any third party, or allow multiple organizations to access the Service under a single account
- Reverse-engineer data: Attempt to identify, isolate, or reverse-engineer the data of any individual operator from aggregated benchmarks
- Scrape or redistribute: Systematically extract, scrape, or redistribute AskJim data, reports, or benchmarks without express written permission
- Misrepresent data: Present AskJim benchmarks as your own proprietary data or misrepresent the source of the information
6. Data Accuracy
Market reference data presented through the Service is derived from operator-submitted data that has been anonymized and aggregated in accordance with Section 3. While AskJim makes reasonable efforts to ensure accuracy, we do not guarantee the completeness, accuracy, or timeliness of any market reference information.
Operator-submitted data is self-reported by participating operators. AskJim does not independently verify operator-submitted data and is not responsible for errors, omissions, or inaccuracies in data submitted by operators.
AskJim benchmarks and reports are intended as general market intelligence and should not be the sole basis for significant business decisions. Users are encouraged to conduct their own due diligence and consult appropriate professional advisors.
7. Privacy
AskJim is committed to protecting the privacy of its users and the confidentiality of operator-submitted data. Our full privacy practices are described in our Privacy Policy.
Key privacy commitments:
- Individual operator data is never shared with other operators, competitors, or third parties
- Personal information collected through account registration is used solely for account management and Service delivery
- AskJim does not sell personal information or operator data to third parties
- Data is stored securely using industry-standard encryption and access controls
8. Intellectual Property
All aggregated benchmarks, reports, analysis, indices, and other outputs generated by AskJim are the intellectual property of AskJim. This includes, but is not limited to:
- Aggregated market benchmarks and indices
- Report formats, visualizations, and presentation methods
- Proprietary algorithms and methodologies used to generate benchmarks
- The AskJim name, logo, and brand assets
Users are granted a limited, non-exclusive, non-transferable licence to access and use AskJim benchmarks for internal business purposes only. This licence does not permit redistribution, resale, or public display of AskJim data without prior written consent.
For clarity, operators retain full ownership of their own submitted data. By submitting data to AskJim, operators grant AskJim a non-exclusive licence to use that data for the purpose of generating anonymized, aggregated benchmarks.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- AskJim provides the Service on an "as-is" and "as-available" basis, without warranties of any kind, express or implied
- AskJim does not warrant that the Service will be uninterrupted, error-free, or free of harmful components
- AskJim shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service
- AskJim's total liability for any claim arising out of or related to these Terms or the Service shall not exceed the total fees paid by you to AskJim in the twelve (12) months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
